1. Service Description
King County Property Tax Appeal ("the Service") is a data analysis and document preparation tool that generates property tax appeal documents based on publicly available King County property and sales data. The Service is operated by LUMINOUSMEN LLC, a Washington limited liability company ("we", "us").
2. Not Legal Advice
The Service is not a law firm and does not provide legal advice. No attorney-client relationship is created by using this Service. Generated documents are drafts for your review — you are solely responsible for verifying all information and deciding whether to file an appeal. We strongly recommend consulting a licensed attorney or tax professional if you have questions about your specific situation.
3. Data Accuracy
Property data, assessed values, and comparable sales are sourced from public records maintained by King County. While we strive for accuracy, we do not guarantee the completeness or accuracy of any data. Assessed values and sales records may contain errors from the original source. You should verify all information independently before filing any official documents.
4. No Guarantee of Outcome
We do not guarantee that using this Service will result in a successful appeal or any reduction in your property tax assessment. Appeal outcomes are determined solely by the King County Board of Equalization.
5. Payment and Refunds
The Service charges a one-time flat fee of $39 for generating appeal documents. Payment is processed securely through Stripe. Since documents are delivered immediately upon purchase as a digital download, refunds are generally not available. If you experience a technical issue that prevents delivery, contact kingcountytaxappeal@gmail.com.
6. Your Responsibilities
- Review all generated documents before filing
- Verify the accuracy of all pre-filled information
- Meet all applicable deadlines (including the July 1 filing deadline)
- Provide accurate information when using the Service
- Understand that signing and filing documents is your decision and responsibility
7. Intellectual Property
Documents generated by the Service are yours to use for your property tax appeal. The Service itself, including its code, design, and data compilation, remains our intellectual property.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service ($39).
9. Indemnification
You agree to indemnify, defend, and hold harmless the Service and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your filing of any documents generated by the Service; (c) any inaccuracies in information you provided; or (d) your violation of these Terms.
10. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by a mutually agreed-upon arbitrator in King County, Washington, in accordance with Washington state arbitration law. Each party shall bear its own costs. Notwithstanding the above, either party may bring claims in small claims court in King County, Washington, if the claim qualifies.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. Any litigation not subject to arbitration shall be brought exclusively in the courts of King County, Washington.
12. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
